Abstract

New varieties of soft wheat have been created at the Kyrgyz Research Institute of Agriculture. They are included in the State Register of plant varieties and hybrids approved for use on the territory of the Kyrgyz Republic. Patents were obtained for seven varieties of wheat: Adyr, Kayrak, EKHOL, Ralyub, Dank, Nazdan and Taazhi. The Vassan wheat variety is undergoing a DYUZ-examination, as a result of which a patent will also be obtained for it. The presence of a patent for wheat varieties makes it possible for its owner to protect his rights when concluding a license agreement. The organization of the collection of royalties is one of the forms of royalty, carried out as periodic interest payments. The license agreement is valid only after its registration in Kyrgyzpytent. According to the Law of the Kyrgyz Republic “On Seeds”, seed producers must conclude a license agreement with the patent owner. An agreement on the amount and terms of payment of remuneration is concluded between the owner of the patent and the author of the variety. Marketing of varieties for which a title of protection has been obtained is carried out by the administration of the institute, which makes it possible to protect their rights from any kind of violation
